Product information

Shindigs offer to supply the helium filled balloon selected by you. Each helium balloon will be secured by a ribbon and a weight and sent in boxes that are deemed suitable for this type of product by Royal Mail. If additional products are ordered, these will also be sent in the same box.

The average flying time for an 18" foil helium balloon is 4-6 days.  You should note that in cold temperatures the helium balloon may appear deflated, however when placed in a warm environment the helium expands and the balloon will be inflated once again.

Please note that our balloons are inflated with helium gas - for your safety and wellbeing we suggest that you do not inhale the gas directly, or attempt to syphon it off.

Ordering and payment

By placing an order and ticking the acceptance box during the order process:

1. you accept our terms and conditions,
2. you are confirming you are at least 18 years of age if you are purchasing alcohol, and
3. you authorise payment to be taken for the order.

Payment will be debited from your credit/debit card as the order is processed. For your security and peace of mind, Shindigs uses the PayPal secure payment system. This means that your credit card details are stored safely at PayPal.

All credit card transactions are checked prior to orders being sent out. Please make sure that the details you give us are correct. We accept no responsibility for any order delayed as a result of incorrect payment details being given.

Your order will be confirmed by e-mail from PayPal. If no email confirmation is received then the order may not have been processed correctly.  Should this be the case please contact us to ensure the correct delivery of your order.

At the time of ordering you must provide a correct daytime telephone number and e-mail address. Failure to provide this may result in the order not being sent.

Substitution

We reserve the right to substitute balloons, chocolates, teddy bears, wine and/or hamper contents with a similar choice if the product(s) selected are out of stock. Where time allows before despatch we will contact you to give the option of cancelling the order or accepting the substituted goods.

Where we make substitutions it will be with a product of equal or greater value.

Delivery

Free delivery only applies to an 18" helium balloon sent by First Class mail.  Charges for postage and packaging are displayed on the website.

All of our UK deliveries are sent by Royal Mail First Class post unless next day guaranteed delivery is selected at the time of placing the order.

First Class mail aims to deliver next working day, including Saturday, of any week excluding any public or bank holidays in any part of the UK or Northern Ireland.  This does not include Sundays, Bank Holidays, Christmas Day, Boxing Day and New Years Day.  First Class mail is by no means guaranteed and shindigs.co.uk will not be held responsible for late deliveries when choosing this service.  If you require guaranteed delivery you must select the next day guaranteed delivery service.

The next day guaranteed delivery service is sent via Royal Mail Special Delivery Next Day before 9.00am or 1.00pm (dependant on service selected).  The next day service delivers Monday to Friday of any week excluding any public or bank holidays.  We do not offer guaranteed delivery on Saturdays, or deliver on Sundays, Bank Holidays, Christmas Day, Boxing Day and New Years Day. Orders must be received by 1.00pm in order to be delivered the next day before 9.00am or 1.00pm (dependant on service selected).  Orders for a Monday delivery must be placed by 1.00pm on the Friday of the previous week.   This service guarantees delivery by 9.00am or 1.00pm (dependant on service selected) of the next working day to 99% of the United Kingdom, including Northern Ireland, Jersey and Guernsey.  The following tables detail the Postcodes where we cannot guarantee your item will arrive by 9.00am or 1.00pm (dependant on service selected)the next working day, with full details on the timeframe in which we do guarantee delivery.

A Signature will be obtained on delivery of the item from the recipient but not necessarily the addressee.  In the event that no-one is available to receive the item, a card will be left providing the addressee with the option to have the item delivered at a later date.  The attempted delivery shall constitute delivery for purposes of our guarantee.

Once the delivery has been signed for at the given address it is no longer the responsibility of Shindigs Ltd.  Refunds cannot be given if the balloon is not passed on to the named recipient.

Shindigs Ltd cannot be held responsible for incorrect delivery information supplied by the customer. Incorrect address details can delay delivery.

If for any reason Shindigs Ltd is unable to fulfil its delivery promise a full refund will be given. Shindigs Ltd cannot be held liable for any consequences or costs further than that of the full amount paid for the helium balloons.

Helium balloons sent to hospitals, military bases and business addresses will be delivered to a main reception or mailing room prior to internal distribution. We recommend that balloons sent to these locations be requested for delivery on a weekday and not on a Saturday.

No change can be made to the delivery address once the order has been confirmed.

Cancellation

By virtue of the Distance Selling Regulations once the goods have been despatched we are exempt from giving cancellation rights, as the goods we are providing are perishable.

Orders may be cancelled up to 48 hours prior to the requested delivery date and a full refund will be issued within 30 days of cancellation.

No refund will be given for orders cancelled within 48 hours of the intended delivery date. We will make every effort to stop such a delivery taking place, but offer no guarantee.

Refunds

Refunds will only be issued for goods not delivered or damaged goods when returned complete with original packaging, in a new and unused state, within 5 working days of the delivery date to:  Shindigs Ltd, Returns,  189 Charlbury Road, Wollaton, Nottingham, NG8 1NF.  Failure to follow these guidelines may result in the claim being rejected.

You will be liable for all postage costs incurred as a result of returning an item to us. We cannot issue a refund until we have received the goods. We recommend you obtain proof of posting when you return any goods to us.

When additional items have been sent the refund amount will only apply to the defective product.

Claims for 'goods not delivered' refunds should be notified in writing within 5 working days.

No refunds will be given for late deliveries. Any dates quoted for delivery of orders are approximate only and Shindigs Ltd shall not be liable for any delay in delivery however caused. Time for delivery shall not be of the essence unless previously agreed by Shindigs Ltd.

In the event of a claim, settlement will be limited to the value of the goods and the cost or the return postage (if applicable) and will in no way extend to consequential loss, howsoever caused.

Returns and complaints

We will not accept returns (unless as a claim for damaged goods) and unwanted balloons, chocolates and/or teddy bears.

General

We reserve the right to amend or supplement these terms and conditions from time to time. It is your responsibility to review our terms and conditions on our website.

These terms and conditions shall be deemed to include all other notices, policies and disclaimers and other terms contained within the Shindigs website, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these terms and conditions shall prevail. If any of these terms and conditions are held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect provided that are capable of continuing in existence without the unfair term.

These terms and conditions shall be governed and construed in accordance with English Law and the parties agree to submit to the jurisdiction of the English courts.
